Terms of Service

Welcome to CarItch. By accessing or using caritch.com (the "Site"), you ("you", "user") agree to these Terms of Service ("Terms"). If you don't agree, don't use the Site.

1. Who we are

CarItch is operated by ParkPlus ("we", "us"), based in India. Contact: parkplus.co@gmail.com.

2. What the Site does

CarItch publishes a ranked index of car-ownership problems ("itches") reported by Indian consumers, aggregated from public sources and direct submissions. We use AI (Groq / Llama) to cluster, describe, and score these problems. Brands may submit claims indicating they offer solutions; these are reviewed before being published.

3. Eligibility

You must be at least 18 years old to submit problems, cast votes, or submit brand claims. Browsing does not require an account.

4. Your use of the Site

You agree to:

• Use the Site lawfully and in good faith.
• Provide accurate information in any submission.
• Not attempt to scrape content en masse, disrupt the Site, or circumvent rate limits.
• Not manipulate votes, including by creating multiple accounts, coordinating votes, or offering compensation for votes.
• Not post content that is illegal, defamatory, obscene, threatening, hateful, or infringing.

4.1 Good-faith use of rights and processes

Rights available to you under these Terms, our Privacy Policy, or applicable law must be exercised in good faith. You agree not to:

• File vexatious, repetitive, or manifestly unfounded data-rights requests, grievances, or reports.
• Use automation, scripts, or coordinated accounts to mass-submit complaints, erasure requests, or reports.
• Impersonate another person, furnish false particulars, or suppress material information when exercising any right.
• Use our grievance or data-rights processes to harass us, our contributors, or claim brands, or to extract commercial concessions.

Breach of this section may result in suspension or termination of your access without prejudice to our other remedies, including recovery of reasonable costs. Making a false or frivolous data-rights request may additionally attract penalties under §15 read with §33 of the Digital Personal Data Protection Act, 2023.

5. User submissions

5.1 Ownership

You retain ownership of the text you submit. By submitting, you grant us a worldwide, royalty-free, non-exclusive, sublicensable license to display, reproduce, translate, modify (e.g., AI rewriting titles), and distribute your submission as part of operating the Site. This license survives termination so long as the content remains associated with a published itch.

5.2 AI-assisted processing

Submitted text is passed to AI models (currently Groq / Llama 3.3) for classification, title rewriting, and scoring. You accept that AI output may be imperfect and that rewritten titles and generated descriptions may not exactly match your original wording. You may ask us to review or remove any misrepresentative output via email.

5.3 Moderation

We may edit, reject, remove, or unpublish any submission that violates these Terms or that we otherwise judge unsuitable, at our sole discretion.

6. Brand claims

If you submit a claim on behalf of a brand ("Claimant"):

• You represent and warrant that you are authorized to act on behalf of the brand named, and that the product/service described actually addresses the claimed itch.
• We manually review each claim and reserve the right to approve, reject, pause, or remove claims at any time.
• Publication of a claim is not an endorsement, certification, or warranty by CarItch.
• Commercial terms (placement fees, renewal, etc.) are agreed separately over email. These Terms do not themselves create such a commercial agreement.
• Approved claims are subject to expiry (default 90 days from approval) and may be auto-paused after user reports exceeding a threshold.
• Users may cast "yes / no / neutral" opinions on published claims. These community signals influence ranking but do not constitute legal or editorial judgments by CarItch.

7. Intellectual property

The Site, its design, source code, and the CarItch name and logo belong to us. You may share links, screenshots, and excerpts with attribution. Do not copy substantial portions of the ranked index, scrape the database, or rebrand the content as your own.

8. AI-generated content disclaimer

Itch titles, descriptions, and scores are generated or influenced by AI models operating on aggregated source material. They represent best-effort summaries and statistical signals, not factual assertions by CarItch about any specific brand, product, incident, or individual. If you believe a published itch misrepresents facts about you or your organization, email parkplus.co@gmail.com and we will review promptly.

9. Third-party links and brand pages

Claimed itches link to third-party websites operated by brands. We do not control these sites and are not responsible for their content, privacy practices, or availability. Clicking a "Visit brand" link takes you away from CarItch.

10. Disclaimers

11. Limitation of liability

To the maximum extent permitted by law, CarItch and its operators shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to your use of the Site, including loss of profits, data, goodwill, or business opportunities.

Our aggregate liability for any claim arising out of or relating to the Site or these Terms is limited to INR 1,000 or the amount you paid us in the preceding 12 months, whichever is greater.

12. Indemnification

You agree to defend, indemnify, and hold harmless CarItch, ParkPlus, and their affiliates from any claim, loss, or expense (including reasonable legal fees) arising from:

• Your content or claim submissions.
• Your violation of these Terms.
• Your infringement of any third party's rights.

13. Termination

We may suspend or terminate your access to the Site (including sign-in, voting, claim privileges) at any time, with or without notice, for breach of these Terms or for any other reason. You may stop using the Site at any time. Sections 5.1 (license), 10–12, and 15–17 survive termination.

14. Changes

We may update these Terms from time to time. Material changes will be indicated by updating the "Last updated" date and posting a notice on the Site. Continued use after changes means you accept the revised Terms.

15. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising under or related to these Terms or the Site shall be subject to the exclusive jurisdiction of the courts in Delhi, India.

17. Miscellaneous

• Severability — if any provision is unenforceable, the rest remain in effect.
• No waiver — our failure to enforce a right is not a waiver of that right.
• Entire agreement — these Terms plus the Privacy Policy constitute the full agreement between you and CarItch regarding use of the Site.
• Assignment — you may not assign your rights under these Terms; we may assign ours to a successor entity.
